Customer

The Customer agrees to comply with these terms and conditions and the terms and conditions of the merchant when purchasing products and services on NaviKotka Oy's Internet services.

Ordering

General terms and conditions

The prices shown on the online service are subject to VAT.

We sell products to private individuals and business customers.

We reserve the right to change prices.

The customer is responsible for the accuracy of the information provided.

We reserve the right to change our terms of delivery. The customer must check the current delivery conditions before placing an order.

Booking conditions

These terms and conditions apply to products and services for hire and reservation. These are collectively referred to as the "item".

Booking

The customer is responsible for familiarising himself with the description and instructions of the item(s) to be booked and the terms and conditions relating to the booking.

The booking made by the Customer is binding when the order/payment confirmation is sent to the email address provided by the Customer.

The customer pays for the reservation according to the payment method of his choice and in accordance with the terms and conditions of the payment method.

The booking system sends the order/payment confirmation to the e-mail address indicated by the customer.

NaviKotka Oy is not responsible for an unsuccessful booking and the customer should contact NaviKotka Oy without delay to rectify the situation.

NaviKotka Oy does not guarantee that the destination is still available in this situation.

If the property is not available, the money will be refunded or, if possible, another property will be offered in its place.

Cancellation of the transaction

Courses and cruises that are not cancelled in full or are cancelled after confirmation will be charged in full.

No refunds are available for online purchases.

The date of cancellation is the date on which NaviKotka Ltd is informed of the cancellation.

Owner's right to cancel the booking

NaviKotka Oy is not liable for any damage or expenses that the customer may incur due to natural conditions, such as unexpected weather variations.

NaviKotka Oy has the right to cancel the booking or make changes to the agreed itinerary for reasons beyond its control, such as force majeure or weather conditions.

In such cases, the customer is entitled to a full refund of the cruise booking paid.

Any costs incurred by the customer for a cruise reservation cancelled due to force majeure will not be refunded.

Damage compensation

The participant must follow the instructions of the course instructor. The course participant must not damage NaviKotka Oy's premises, furniture or teaching equipment.

The cruise passenger must follow the instructions and orders given by the ship's officers, staff or authorities during the trip, as well as the rules of order of the means of transport. The passenger must not disturb other passengers or the navigation of the vessel by his/her behaviour. If a passenger commits a serious breach of duty, for example by being drunk or disorderly, he or she may, at the discretion of the ship's master, be refused embarkation or be removed from the voyage. In this case, the passenger is not entitled to a refund. The passenger is liable for any damage caused to NaviKotka Oy by his/her intentional or negligent conduct or third parties.

NaviKotka Ltd is not liable to compensate for any property, such as money, securities or other particularly valuable property, which the company has not taken into custody.

NaviKotka Oy also exempts itself from liability for personal injury and damage caused by delay to the passenger during the period before the passenger's arrival on board or after the passenger has disembarked. The passenger is liable for the damage and delay in accordance with the Maritime Law. NaviKotka Ltd's liability under the terms of the contract begins when the passenger arrives on board and ends when the passenger leaves the vessel.

NaviKotka Ltd does not compensate for any damage or expenses caused to the customer by natural conditions, such as insects, animals, sledging or unexpected weather changes.

Complaints

Any complaints should always be made as soon as possible after the matter has arisen.

If the matter is not resolved satisfactorily or involves a claim for compensation, the complaint must be sent within one month.

NaviKotka Ltd will endeavour to deal with the complaint as quickly as possible, but within one month at most.

If the customer and NaviKotka Oy cannot reach an agreement, the customer may refer the dispute to the Consumer Complaints Board.

Delivery conditions

Conclusion of the contract

The binding contract for the transaction comes into force when the order is confirmed (order confirmation/payment confirmation).

The order confirmation/confirmation of payment is sent to the customer by e-mail.

Payment terms

NaviKotka Ltd uses reliable and secure payment methods for its services.

NaviKotka Ltd does not store bank account or credit card information at any time.

The customer agrees to comply with the terms and conditions of the payment method chosen.

Payment by invoice

The invoice must be paid by the due date indicated on the invoice.

Invoices paid after the due date will always be subject to late payment charges. If the invoice is paid after the due date on the original invoice and late payment charges have already been incurred, the charges will be invoiced separately.

If the payment transaction has not been successfully completed at the time of the order, NaviKotka Ltd will not process the order.

Payment service provider

The payment intermediary and payment service provider is Paytrail Oyj (2122839-7) in cooperation with Finnish banks and credit institutions. Paytrail Oyj appears as the payee on the statement of account or card bill and forwards the payment to the merchant. Paytrail Oyj has a payment institution licence. In case of complaints, please contact the supplier of the product in the first instance.
